Copyright is a legal right created by the law of a country, granting the creator of an original piece of work exclusive rights to its use and distribution. If someone breaks the copyright laws, the holder of it is able to sue the person for a fee. There are copyright free images that can be find in internet under web pages that are identified as copyright free, these images can be taken and freely used by anyone. Using these images will prevent the user from being charged with copyright.
Before using an image that you have found, the user should ask the owner of the image/design whether or not the image is allowed to be used in order to prevent a copyright scandal. Usually the user for the image would be required to pay the designer in order to use their design.
If you are caught using copyright images and designs, the ISP (internet service providers) will shut down your site without you knowing due to breaching terms and conditions of their hosting agreements. Furthermore you could find yourself being sued if you made a profit from the copyrighted images/designs because that affects the owner of the copyrighted image. The owner of the image could lose out on money therefore suing the user of their copyrighted image.
Trademark is a recognizable sign, design or expression which identifies products or services from a particular source from those of others. The trademark owner can be an individual, business organization, or any legal entity. Depending on the extent of trademark violation, you can be taken to court for trademark infringement or fraud. You will be required to destroy all infringement materials and pay a fee to the holder of the trademark.
Intellectual property is a legal term used in reference to the creation of mind. Examples of intellectual property include; music, literature and other artistic work. Under intellectual property laws, the owners are granted certain exclusive rights. Intellectual property legislation's are a form of property under the form of intangible property.
Intellectual property drives profit for an organization/business/creator, therefore if someone has used their property and is caught doing so, they can be fined as it is considered disrupting business and profitability for the creator. Due to it being considered intangible property the creators of the property are allowed to share or transfer ownership of the property however an unrelated business/user will be prosecuted for using the property without it being transferred from the creator.
